Welcome to Snore Sense. These Terms of Use ("Terms") govern your use of the Snore Sense mobile application (the "App") provided by Snore Sense ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Please read these Terms carefully before using the App. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that:

  • You are at least 13 years of age
  • You have read, understood, and agree to be bound by these Terms
  • You have read and acknowledge our Privacy Policy
  • If you are using the App on behalf of an organization, you have the authority to bind that organization to these Terms

2. Description of Service

Snore Sense is a mobile application designed to:

  • Record audio while you sleep to detect snoring sounds
  • Analyze snoring patterns and provide a snore score
  • Track contributing factors and remedies you log
  • Display trends and insights about your snoring over time
  • Provide information about snoring remedies and products

3. Medical Disclaimer

IMPORTANT: Snore Sense is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

The App is designed for informational and educational purposes only. The information provided by the App, including snore scores, analysis, and remedy suggestions:

  • Should not be considered medical advice
  • Should not replace consultation with a qualified healthcare provider
  • Should not be used to make decisions about your health without consulting a doctor
  • May not detect all sleep-related conditions, including sleep apnea

If you suspect you have a sleep disorder, sleep apnea, or any other medical condition, please consult a qualified healthcare professional immediately. Snoring can be a symptom of serious health conditions that require medical attention.

We expressly disclaim any liability for any health-related decisions you make based on information provided by the App.

4. User Accounts and Data

4.1 Your Data

All data you create within the App, including audio recordings, sleep sessions, and personal information, is stored locally on your device. You are responsible for:

  • Maintaining the security of your device
  • Backing up any data you wish to preserve
  • Understanding that uninstalling the App will permanently delete all App data

4.2 Accuracy of Information

You agree to provide accurate information when using the App, including during onboarding (age, height, weight, etc.). Inaccurate information may affect the quality of insights provided by the App.

5. Subscriptions and Payments

5.1 Free and Premium Features

The App offers both free features and premium features available through a subscription to "Snore Sense Pro." Free users may access limited features, including a limited number of recordings.

5.2 Subscription Plans

We offer the following subscription options:

  • Monthly: Billed monthly, renews automatically
  • Yearly: Billed annually, renews automatically
  • Lifetime: One-time purchase, no renewal required

5.3 Payment Processing

All payments are processed by Apple through the App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases. We do not have access to your payment card information.

5.4 Automatic Renewal

Monthly and yearly subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

5.5 Managing Your Subscription

You can manage or cancel your subscription at any time through:

  • Your Apple ID account settings on your device
  • The App Store app
  • The subscription management screen within the App

5.6 Refunds

Refunds are handled by Apple according to their refund policies. To request a refund, please contact Apple Support or use the "Report a Problem" feature in your purchase history. We cannot process refunds directly.

5.7 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but may apply upon renewal. We will provide notice of any price changes as required by the App Store.

6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Record audio of other people without their knowledge and consent
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Use the App to transmit any viruses, malware, or harmful code
  • Remove, alter, or obscure any copyright or proprietary notices
  • Use the App for any commercial purpose without our written consent
  • Share or distribute any premium content or features without authorization

7. Intellectual Property

7.1 Our Ownership

The App, including its design, features, content, and underlying technology, is owned by Snore Sense and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

  • Modify or create derivative works based on the App
  • Sublicense, sell, or transfer your rights to use the App
  • Use the App's content or branding for any commercial purpose

7.3 Your Content

You retain ownership of any content you create within the App, including audio recordings and notes. By using the App, you grant us a limited license to process this content solely to provide the App's features to you.

8. Third-Party Links and Services

8.1 Affiliate Products

The App may display recommendations for third-party products and services related to snoring remedies. These recommendations contain affiliate links, and we may earn a commission if you make a purchase through these links.

We do not endorse, guarantee, or assume responsibility for any third-party products or services. Your interactions with third-party websites and merchants are solely between you and the third party, and you should review their terms and privacy policies before making any purchase.

8.2 Third-Party Services

The App uses third-party services, including RevenueCat for subscription management. Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimers

9.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.2 No Guarantee of Results

We do not guarantee that:

  • The App will meet your specific requirements or expectations
  • The App will be uninterrupted, timely, secure, or error-free
  • The snoring analysis or snore scores will be completely accurate
  • Any remedies or suggestions will reduce or eliminate your snoring
  • The App will detect all snoring events or sleep-related issues

9.3 Audio Recording Limitations

The accuracy of audio recording and snoring detection may be affected by:

  • Background noise in your environment
  • Device microphone quality and placement
  • Other sounds in your sleeping area
  • Device settings and battery optimization features

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SNORE SENSE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or use
  • Any damages arising from your use of or inability to use the App
  • Any damages arising from any health decisions made based on App information
  • Any damages exceeding the amount you paid for the App in the twelve (12) months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Snore Sense and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any content you create or submit through the App

12. Termination

12.1 Your Right to Terminate

You may stop using the App at any time by uninstalling it from your device. If you have an active subscription, please cancel it through your Apple ID settings before uninstalling to avoid future charges.

12.2 Our Right to Terminate

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms.

12.3 Effect of Termination

Upon termination:

  • Your license to use the App is immediately revoked
  • You must uninstall the App from all your devices
  • Provisions that by their nature should survive termination will survive (including disclaimers, limitation of liability, and indemnification)

13. Changes to Terms

We may modify these Terms at any time. When we make changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Notify you through the App for material changes

Your continued use of the App after any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

14. Governing Law and Disputes

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue other legal remedies.

14.3 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Snore Sense regarding the App and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights, except that Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to App Store-related provisions.

16. Apple-Specific Terms

The following terms apply to your use of the App on Apple devices:

  • These Terms are between you and Snore Sense, not Apple
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product warranties, whether express or implied
  • Apple is not responsible for addressing any claims relating to the App
  • Apple is a third-party beneficiary of these Terms and may enforce them against you
